甚至限制我國企業(yè)參加國際展會(huì)的參展機(jī)會(huì)和面積的初衷。一些發(fā)達(dá)國家把知識產(chǎn)權(quán)作為維護(hù)本國利益和經(jīng)濟(jì)安全的一項(xiàng)戰(zhàn)略資源，一些企業(yè)將知識產(chǎn)權(quán)視為獲取市場競爭優(yōu)勢的一種重要手段，這充分表現(xiàn)在他們強(qiáng)烈的保護(hù)意識和積極主動(dòng)的實(shí)際行動(dòng)上。所以我國的企業(yè)要尊重知識，尊重創(chuàng)新的前提下，自己不侵犯別人的知識產(chǎn)權(quán)，同時(shí)也要學(xué)會(huì)保護(hù)自己的權(quán)利不受他人的侵犯。
The reason why Chinese enterprise frequently encounter claims while attending exhibition abroad cannot exclude that foreign powers suppress exported products from China and restrain Chinese enterprises of the opportunities and square of attending international exhibition.
Some advanced countries regard IPR as a strategic resource to safeguard its own economic benefits and safety and some enterprises take IPR as an important means to acquire market competition advantage through showing their strong sense of protection and practical act. Our enterprise shall not infringe other’s IPR and learn how to protect its own IPR from infringement under the premise of respecting knowledge and innovation simultaneously.
（二） 尋找侵權(quán)證據(jù)
Finding evidence of tort
尋找侵權(quán)線索實(shí)際上是尋找國外公司侵犯我們知識產(chǎn)權(quán)的證據(jù)，在國外取證一定要符合國外的法律規(guī)定，每個(gè)國家的法律規(guī)定都有所不同，在中國是合法的取證手段，在國外可能被看成是非法，其證據(jù)將被認(rèn)定無效，有的證據(jù)形式是合法的，但是我們?nèi)∽C的手段不符合國外的法律規(guī)定，同樣該證據(jù)也無效。關(guān)于取證最好還是委托國外的律師來全權(quán)處理。
Finding tort clue means to find the evidence that foreign company infringes our IPR. Obtaining evidence abroad, we shall comply with local laws and regulations because laws and regulations regarding obtaining evidence vary from country to country. Means proved to be legitimate while obtaining evidence in China may be regarded illegally abroad. If the means of obtaining evidence is proved to be illegal, then the evidence acquired will be regarded null and void. It’s better to entrust foreign lawyer to obtain evidence.
（三） 及時(shí)投訴

在國際展會(huì)上，我國參展企業(yè)的知識產(chǎn)權(quán)同樣面臨被其他國家的企業(yè)侵權(quán)的情形。河南洛陽名特玻璃技術(shù)有限公司在一次國際展會(huì)上發(fā)現(xiàn)奧地利一家公司完全照抄自己的鋼化爐生產(chǎn)線宣傳材料，名特公司立即在律師的陪同下對其提出警告，并勒令其糾正錯(cuò)誤，經(jīng)我方據(jù)理力爭和強(qiáng)烈要求下，外方改正其作法，并承認(rèn)錯(cuò)誤。
On international exhibition, our exhibitors similarly face the situation that IPR may be infringed by enterprises from other countries. Henan Luoyang Mingte glass technical co.,ltd. once found an Austrian company completely copied its own publicity materials on an international exhibition. Mingte company , accompanied by lawyer, addressed warning to this company and compelled it to revise its mistake. Upon our strong argument on the just grounds and request, foreign party finally revised their act and acknowledged their mistake.
總之，我國參展企業(yè)應(yīng)重視參展過程中侵權(quán)和被侵權(quán)的可能性存在，事先綜合分析各項(xiàng)因素的存在。只有這樣，參展企業(yè)才能避免侵權(quán)的同時(shí)，自身權(quán)益也能夠得到有效保護(hù)。
In a word, our exhibitors shall put emphasis on the existing possibilities of infringement and being infringed on the exhibition and analyze various kinds of elements previously. Only by doing this, exhibitors can avoid infringement of other’s IPR and protect its rights and benefits effectively.
